These terms and conditions will remain in effect indefinitely and will apply to all contracts made through the AGRÍCOLA Y GANADERA EL TORIL S.L. website. El Toril informs that it is responsible for and is familiar with the current legislation of the countries to which it offers services and reserves the right to unilaterally modify these terms, without affecting previously contracted goods or promotions.

Access to the Website
Access to the website is free, except for the cost of the telecommunication connection provided by your service provider.

Access to the WEBSITE will not require user registration unless otherwise specified.

Likewise, El Toril does not guarantee the absence of interruptions or errors in the access to the website or its content, nor that it will be permanently updated, free of inaccuracies or mistakes. In any case, we will make every effort to rectify any errors, communication interruptions, or lack of content updates as soon as possible.

Usage Rules
You agree to use the Website and all its content and services in accordance with the law, morality, public order, and these General Conditions. Additionally, you agree to make proper use of the services and/or content of the Website and not to use them for illegal activities or activities that may be considered crimes, violate the rights of third parties, and/or infringe intellectual and industrial property laws or any other applicable legal norms.

VI.- Not to spread, transmit, or make available to third parties any information, element, or content that constitutes a violation of intellectual and industrial property rights, patents, trademarks, or copyrights belonging to the WEBSITE’s owners or third parties.

• You agree to hold El Toril harmless from any potential claims, fines, penalties, or sanctions it may be obligated to bear as a result of your breach of any of the rules outlined in this document, and El Toril reserves the right to seek compensation for damages.

General Terms and Conditions of Contract

El Toril provides access to the WEBSITE to facilitate access to information regarding the accommodation services detailed in its content, and for users to contact us or book our services online.

These terms of use govern, together with the Privacy Policy and Cookie Policy, the use of the WEBSITE. Therefore, we make them available for you to access, review, download, or print. Information about the processing of your personal data can be found in the “Privacy Policy” section.

We kindly ask that you read these Terms and Conditions carefully, as they affect your legal rights and obligations.

Acceptance of the Terms of Use and Contract

Browsing through the WEBSITE grants the user (hereinafter referred to as the “USER”) the full and unconditional acceptance of all the provisions included in this document in the version published by El Toril at the time the user accesses the WEBSITE. Consequently, we kindly ask that you carefully read these Terms of Use and Contract each time you plan to use the WEBSITE, as they may be modified.

The use of certain services offered on the WEBSITE may be subject to specific conditions that may, depending on the case, replace, complete, and/or modify this document. Therefore, prior to using such services, you should carefully read the corresponding Specific Terms and Conditions.

El Toril reserves the right to modify the terms of use and contract and the privacy policy of the WEBSITE, and it is the responsibility of the users to review them periodically.

Reservations

Reservations can be made online via the reservation system, by email at [email protected], or by phone at +34 686069505. Once availability has been communicated, the reservation process will ONLY continue via email or online to ensure written documentation. The client must contact El Toril via email at [email protected], providing their full name, ID, mobile number, email address, and place of residence, requesting accommodation in one or more rooms, type of room, for specific dates and a determined number of people.

If the pre-reservation was made via email, El Toril will contact the client, providing pre-reservation details with the dates and check-in/check-out times, the total budget, and reservation and cancellation terms as outlined in the “MODIFICATION AND CANCELLATION OF RESERVATION” section. El Toril will provide the account number for AGRÍCOLA Y GANADERA EL TORIL SL.

Until El Toril receives confirmation that the corresponding payment for the services included in the reservation has been made and has verified the deposit in the account, the reservation will not be considered final and will be regarded as a pre-reservation. The reservation is considered confirmed once El Toril confirms the reservation and its terms by email. The person making the reservation will be responsible for ensuring that all obligations are met by the guests.

Modification of the Reservation

The reservation cannot be modified less than 48 hours prior to the arrival date unless a rate with different cancellation conditions has been booked. The success of the modification will depend on the availability of accommodation at the time of the request.

Cancellation of Reservation

The hotel will charge 100% of the reservation at the time of booking for Bubble, Premium Bubble, and Safari Tent accommodations. For the Villa accommodation, 70% of the total amount will be processed at the time of booking, and the remaining 30% will be processed 7 days before arrival.

Cancellation Types:
• Sale Conditions – Non-Refundable Rate with Date Modification: This rate does not allow refunds in case of cancellation. However, the client can modify the dates of their stay, provided they request it at least 48 hours before the arrival date and subject to availability.
• Sale Conditions – Partially Refundable Rate: The reservation can be canceled up to 20 days before the arrival date. In case of cancellation within this period, the client can choose to:
• Modify the dates of their stay (subject to availability).
• Receive a 50% refund of the total amount paid.
If cancellation occurs within less than 20 days, no refund will be provided.

For weather or force majeure reasons, El Toril reserves the right to cancel any reservation and may opt to reschedule the reservation for a later date after the obstacle is resolved or, if necessary, cancel it. In case of cancellation, the full amount of the reservation will be refunded.

Modification requests must be communicated in writing via email from the same address used to make the reservation to: [email protected], including the name and details of the reservation. Bank charges incurred by reservation cancellations will be borne by the client. If El Toril cancels the reservation for force majeure reasons, meaning circumstances beyond their control, abnormal and unforeseeable, whose consequences could not have been avoided despite acting with due diligence, the reservation will be canceled without any right to claims or compensation, except for the return of the amount paid in advance. To prevent misuse of the reservation system, El Toril reserves the right to cancel any pre-reservation where the advance payment is not received within the specified dates if it is impossible to contact the client using the email provided. If, due to circumstances beyond the client’s control, El Toril fails to provide the contracted rooms via the reservation system, they will provide accommodation in establishments of equal or higher official category and characteristics, with the price difference and any other charges for the lack of the contracted service to be covered by the client.

Check-in

Rooms will not be available until 16:00 h.

Check-in Hours:
• Winter: From 16:00 to 20:00
• Summer (June to September, inclusive): From 19:00 to 21:00

The reservation will be guaranteed until 22:00 on the day of arrival. If the user expects to arrive at the hotel later than these times, it is advisable to notify in advance, preferably at the time of the reservation.

Check-out

The client must vacate their room by 12:00 hrs on the departure day, as indicated in the reservation confirmation. A late check-out will incur an additional cost of 10€. Latest check-out times:
• Bubble Rooms and Safari Tents: 14:00
• Villa: 17:00

No-Show Clause

A “no-show” is defined as the failure of the customer to appear at the hotel on the day their stay is scheduled to begin, at the expected arrival time, without having previously canceled the service. In this case, the reservation will be kept until 10:00 PM, and will be canceled if no contact has been made by the customer by this time.

Price

The prices for each service are those valid according to the price list of El Toril at the time of service provision. All prices include value-added tax. Special packages, offers, and last-minute prices for specific dates may be offered. Subsequent changes to services, whether due to price increases or discounts, will not affect the prices agreed upon in the existing reservation.

Payment

The customer is required to pay for all additional services provided by the hotel. Payment can be made in cash or by credit/debit card upon departure, except in cases of last-minute bookings where no deposit has been made. In these cases, the full amount for the contracted services must be paid upon check-in. El Toril will present the customer with an invoice listing all contracted services, which the customer must confirm and sign before making the payment, which must be completed before departure. If the invoice needs to be issued to a company the guest works for, payment must be made by the guest, unless El Toril expressly authorizes payment from the company in writing. In this case, payment must be made before departure.

Obligations of the Customer

Pay for all contracted services, even if a complaint or claim is presented.

Comply with the specific rules of the establishment whose services the customer enjoys, as outlined in these General Conditions and the Internal Regulations of the Establishment, which are incorporated into these general conditions. The customer must observe hygiene, education, and good manners toward other users, staff, and the establishment’s facilities and furnishings.

Legal Responsibility

Those who cause damage to the building, furnishings, or inventory will be held liable under the applicable laws (this applies especially to group leaders and organizers). Theft and intentional damage will be immediately reported. On the day of departure, El Toril Glamping Experience will conduct an inspection of all rooms. Any costs for replacing damages, theft, or lost keys will be charged in cash upon departure.

El Toril reserves the right to request a deposit from customers as a guarantee. This deposit will be refunded in cash upon departure, minus any potential damages. El Toril is responsible for any damages caused to customers within the establishment and on its grounds, except in cases of recklessness. El Toril does not assume any legal responsibility for luggage stored in rooms or vehicles parked on its property.

Pets

Pets are not allowed in accommodations, except for guide dogs, and only in The Villa.

Service Guarantee

El Toril guarantees the quality of the services provided in accordance with its official category and is responsible for any claims that may arise due to proven deficiencies in its mandatory services as per its official category.

Defects or failures in the facilities not included in the category of accommodations that El Toril provides for the customer will be corrected by El Toril whenever possible. In this context, the customer may not file a claim.

Lost Items

Items left by the customer in various accommodations will be sent to them only upon request and at their own risk. If the customer provided contact details, El Toril will notify them of the forgotten item.

El Toril will keep these items for 3 months. After this period, items with recognizable value will be handed over to the lost-and-found office.

Complaint Forms

El Toril Glamping Experience has complaint forms available for customers. In accordance with current regulations, complaints may only be filed after payment for services has been made.

Jurisdiction and Applicable Law

Both parties expressly and voluntarily submit to the jurisdiction of the courts in El Toril’s location for the resolution of any conflicts arising from the interpretation and application of this contract. The applicable legislation will be Spanish law and the tourism law of Castilla-La Mancha.

Offers

Offers are only valid during the period specified by the establishment in the advertisement, or, if not specified, for the duration that they are accessible to customers for effective booking.

CONDITIONS FOR BOOKING RECREATIONAL ACTIVITIES

AGRÍCOLA Y GANADERA EL TORIL SL, with CIF B-83230961, is a rural tourism company that offers activities in the natural environment where there are inherent risks due to its nature, force majeure, or unforeseen accidents that are beyond human control. By booking our activities, the customer understands and accepts this risk, thus exempting AGRÍCOLA Y GANADERA EL TORIL SL, hereinafter El Toril, from any responsibility in these cases.

The customer affirms that they are not under the influence of alcohol, drugs, and/or narcotics, or any medication that may impair their stability, reflexes, or overall ability to safely participate in the activity.

The customer confirms they do not have cardiovascular diseases, are not pregnant, and do not suffer from any other condition that would prevent their safe participation in the activity. If in doubt, they have consulted a doctor.

If the customer wears prosthetics, glasses, or contact lenses, they accept the risk of damage that the normal course of the activity may cause to them.

The customer agrees to accept the guide’s decisions and follow their instructions at all times to ensure the safety and smooth conduct of the activity.

If the customer does not meet the necessary physical or technical requirements or fails to bring the required equipment, they may be denied participation in the activity, or the activity’s time may be modified or delayed.

When making the reservation as confirmation of the activity(ies), the customer must pay 30% of the total amount. The remainder may be paid before the activity or directly on the day of the activity.

Activities offered by El Toril are subject to the natural environment in which they take place (weather conditions, water levels, etc.), so the company may cancel the activity, even at the beginning of the activity, if weather conditions are not suitable. If cancellation occurs on the same day, the customer may choose to reschedule the activity or receive a 75% refund of the total amount.

Some activities are subject to a minimum number of participants. El Toril may cancel an activity if the minimum is not reached, giving the customer the option to switch to another activity or receive a full refund.

In case of cancellation by the customer, the paid amount will be refunded minus management and organizational fees: 50% if the cancellation occurs within 48 hours of the activity, and 15% if canceled earlier.

Failure to show up for the activity will result in the loss of the full payment.

If a dispute arises that needs to be resolved in court, both parties agree to submit to the jurisdiction of the courts of Toledo/Talavera de la Reina.

El Toril has liability insurance and accident coverage for customers who book our services.

Minors must always be accompanied by an adult or legal guardian who takes responsibility for them. Otherwise, the legal guardian must sign an express authorization in addition to this contract.

El Toril may use images of the customers for advertising purposes, including brochures, website, social media, etc.

Any activity subcontracted by El Toril to another company will be the responsibility of that company in the event of any incident during its execution.

DISCLAIMER

I ASSUME ALL RISKS OF PARTICIPATING IN ANY / ALL ACTIVITIES carried out by EL TORIL GLAMPING EXPERIENCE - AGRÍCOLA Y GANADERA EL TORIL SL B83230961 in N-502 km 93.7 Velada (Toledo), including, by way of example and without limitation, any risk that may arise from negligence or oversight by the released persons or entities, dangerous or defective equipment or property owned, maintained, or controlled by them, or from their potential responsibility without fault.

I CERTIFY that I am in good physical condition, that I have sufficient preparation or training to participate in this activity, and that I have not been advised by a medical professional to refrain from participating.

I CERTIFY that I have no health issues or conditions that would prevent me from participating in this activity.

I recognize that the owners, sponsors, and organizers of the activity I am participating in will use this Waiver and Release of Liability form, which will govern my actions and responsibilities during the activity.

In consideration of my request and allowing me to participate in this activity, I hereby take measures for myself, my executors, administrators, heirs, next of kin, successors, as follows:

(1) I WAIVE, RELEASE, AND DISCHARGE any liability, including but not limited to liability arising from negligence or fault by the released entities or persons, for my death, disability, personal injury, property damage, theft of property, or any actions of any kind that may occur in the future, including my travel to and from this activity, the FOLLOWING ENTITIES OR PERSONS: EL TORIL GLAMPING EXPERIENCE - AGRÍCOLA Y GANADERA EL TORIL SL and/or its directors, officers, employees, volunteers, representatives, and agents, and the activity holders and sponsors;

(2) INDEMNIFY, DEFEND, AND PROMISE NOT TO BRING any claims against the entities or persons mentioned in this paragraph regarding any responsibilities or claims arising from participation in this activity, whether caused by negligence or otherwise.

I RECOGNIZE that EL TORIL GLAMPING EXPERIENCE - AGRÍCOLA Y GANADERA EL TORIL SL and its directors, officers, employees, volunteers, representatives, and agents are NOT responsible for the errors, omissions, or actions of any party or entity conducting a specific activity on their behalf.

I acknowledge that this activity may involve testing the physical and mental limits of a person and carries the risk of death, serious injury, and loss of property. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, the condition of participants, equipment, vehicle traffic, dehydration, and the actions of others, including, but not limited to, participants, volunteers, guides, and/or activity producers. These risks are inherent to participants and also extend to volunteers.

By agreeing to this waiver, I give my consent to receive medical treatment that may be deemed necessary in case of injury, accident, and/or illness during this activity.

I understand that while participating in this activity, I may be photographed. I agree to allow my image, video, or film to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assignees.
